Digital likeness is an AI-generated copy of a real person’s face, voice, or body, and for agencies it turns talent contracts and approvals into an AI question.
Also known as digital replica, AI replica, synthetic persona of a real person
A digital likeness is any synthetic reproduction of a real individual that can be made to say or do new things: a cloned voice, a face-swapped video, or a full 3D or generated replica. It is distinct from a fictional AI character because a real person’s identity and livelihood are attached to it.
Laws are moving quickly and differ by place, with protections for voice, image, and name appearing in statutes, union agreements, and platform policies. This page is a plain-language orientation, not legal advice.
Agencies sit between talent, brands, and production vendors, so likeness issues land on their desk first.
Contracts need explicit AI language. Standard usage terms rarely say whether footage can be used to train or create a replica. Agencies should ask for consent, scope, duration, and compensation to be written out
Approvals multiply. A single shoot can now yield many synthetic edits, such as new languages or new lines of dialogue. Each one should route through the person or their representative
Brand and legal risk. Unauthorized lookalikes and cloned voices can trigger takedowns, disputes, and public backlash, so clearance belongs early in the workflow
A retail client wants one spokesperson ad localized into five languages. The agency’s producer checks the original talent agreement, finds it covers the shoot but says nothing about synthetic voice, and goes back to the talent’s agent before any dubbing starts. They agree on a fee, a list of approved markets, and a review step where the actor hears every localized version before release. The extra week is built into the schedule, and the deliverable log records who approved what.
The automations and agents module of the workshop teaches you how to build AI workflows that compress the busywork without taking the craft out of the studio.
